By signing this consent form, I/we (referred to as "Data Subject") freely, voluntarily, and unconditionally provide my/our consent to the collection and processing of all Personal Data (as defined below) and account or transaction information or records (collectively referred to as "Information") related to me/us, disclosed/transmitted by me/us in person or through my/our authorized agent/representative/s, to the information database system of Blackpearl Media Inc. (hereinafter referred to as "BMI") and/or any of its authorized agent/s or representative/s, as the Information controller, in accordance with applicable data protection laws and regulations.

 

I/we understand that "Personal Data" refers to any information, regardless of being recorded in a material form or not, that: (a) reveals or can reasonably and directly ascertain the identity of an individual by the entity holding the information, or when combined with other information, can directly and certainly identify an individual; (b) pertains to an individual's race, ethnic origin, marital status, age, color, gender, health, education, and religious and/or political affiliations; (c) pertains to any legal proceedings, offenses committed, or alleged to have been committed by an individual, including the outcome of such proceedings or court sentences; and (d) includes government-issued information specific to an individual, such as social security numbers and licenses.

 

Furthermore, I/we understand that BMI will treat the Personal Data and Information, as well as the Business conducted with BMI, with strict confidentiality. I am aware that the collection and processing of all Personal Data and/or Information by BMI may serve any of the following Purposes:

 

a. Making decisions related to the establishment, maintenance, or termination of accounts and provision of services, such as marketing, advertising, content creation, content distribution, content licensing, and other media-related activities;

 

b. Providing, operating, processing, and administering BMI's accounts and services, processing applications for BMI's accounts, products, and/or services, including financial transactions, subscriptions, and maintaining service quality and staff training;

 

c. Undertaking activities related to the provision of BMI's accounts and services, including transaction authorization, customer service, research reports, offering documents, customer profiling, and administration of rewards and loyalty programs;

 

d. Providing product-related services and support, including administrative and processing support, and acting as an intermediary/agent/broker/market participant/counter-party in various media-related products;

 

e. Fulfilling legal, regulatory, and compliance requirements, as well as any applicable treaties or agreements with authorities applicable to BMI;

 

f. Verifying the identity or authority of individuals and responding to requests, questions, or instructions from verified representatives or other parties in accordance with BMI's security procedures;

 

g. Conducting risk assessment, statistical and trend analysis, and planning purposes, including credit, risk, and compliance analysis, background checks, reviews, and maintaining banking, credit, and financial history records;

 

h. Monitoring and recording communications with Data Subjects and Related Persons for record-keeping, quality assurance, customer service, training, investigation, litigation, and fraud prevention purposes;

 

i. Detecting, preventing, investigating, and prosecuting crimes and fraud;

 

j. Enforcing or defending the rights of BMI, its affiliates, employees, and officers;

 

k. Performing internal management and management reporting, operating control and management information systems, conducting business risk, control, or compliance reviews or testing, internal audits, or enabling external audits;

 

l. Enabling an actual or proposed assignee of BMI or participant/sub-participant/transferee of BMI's rights regarding the Data Subject to evaluate or consummate a transaction intended to be the subject of the assignment, transfer, participation, or sub-participation;

 

m. Complying with contractual arrangements or supporting initiatives, projects, and programs by or between media industry self-regulatory organizations, industry bodies, associations of media services providers, or other media institutions, including assisting in background checks or debt collection for other media institutions;

 

n. Managing BMI's relationship with the Data Subject, which may include providing information about the Data Subject or Related Person/s to BMI and its affiliates;

 

o. Marketing media-related products or services to me/us and individuals with similar profiles, attributes, or behavior, conducting market, product, and service research, and designing or refining products or services through data analysis, surveys, and various modes of communication;

 

p. Complying with obligations, requirements, policies, procedures, measures, or arrangements for sharing data and information within BMI and its affiliates, and any other use of data and information in accordance with BMI programs for compliance with applicable laws, regulations, and industry standards.

 

Simultaneously, I/we understand that BMI will retain the Information for as long as necessary to fulfill any of the aforementioned Purposes, and it will continue to be retained for a period of two (2) years, even after the termination of any of the aforementioned Purposes.

 

Additionally, I/we acknowledge that with respect to the submission, collection, and processing of Personal Data of Related Persons, it is my/our duty and responsibility: (i) to inform said Related Persons about the Purposes for which their Personal Data have been submitted, collected, and processed by BMI, (ii) to obtain consent from said Related Persons for the collection and processing of their Personal Data/Information in accordance with applicable data protection laws and regulations, and (iii) to inform BMI that consent has been obtained from said Related Persons.

 

I/we also acknowledge that I/we have been provided with the following written notification about my/our Rights as a Data Subject (each referred to as a "Right", collectively referred to as the "Rights") in accordance with applicable data protection laws and regulations:

 

i. The right to be informed whether Information and/or Personal Data is being or has been processed;

 

ii. The right to request BMI to correct any inaccurate Information and/or Personal Data related to the Data Subject;

 

iii. The right to object to the processing of the Information and/or Personal Data in case of changes or amendments to the supplied or declared Information and/or Personal Data;

 

iv. The right to access the Information and/or Personal Data;

v. The right to suspend, withdraw, or order the blocking, removal, or destruction of the Data Subject's Personal Data from BMI's information database system.

 

Furthermore, I/we acknowledge that if I/we exercise any of the aforementioned Rights, BMI reserves the right to re-evaluate and/or terminate its Business with me/us, as well as any of the Purposes and/or BMI services/products for which the Information and/or Personal Data has been collected and processed.

 

I/We have read, understood, and hereby consent to, agree on, accept, and acknowledge these terms of consent for myself/ourselves and/or as agent/s for and on behalf of the principal/s I/we represent.

 

Given the above, I/we hereby confirm my/our consent to the collection and processing of the Personal Data and/or Information by BMI in accordance with the Purposes and subject to the terms and conditions stated above.

 

vi. No modification or alteration of this Contract shall be considered as having been made unless executed in writing and duly signed by the parties hereto.

 

This Agreement, including the documents attached herein, shall constitute the one and the same agreement between the Parties. The Agreement supplants any other previous oral or written commitments, agreements, or understanding. Further, this Contract may not be modified, changed, or otherwise altered in any respect except by a written agreement and consent signed by both Parties.
